(ORAL) Having suffered concurrent adverse findings by the two Courts below, appellant-plaintiff is in second appeal before this Court assailing learned trial Court judgment and decree dated 31.08.2012, as upheld by learned First Appellate Court vide its judgment and decree dated 26.03.2014, dismissing suit for declaration filed by plaintiff.

Earlier also, main appeal was dismissed for non-prosecution on 25.07.2022. Thereafter, vide order dated 05.08.2022, same was restored to its original number. Today, when called up for hearing, again none appears on behalf of appellant. It seems that appellant is not interested in pursuing the appeal. 3.

Dismissed in-default.
