DEEPAK GUPTA , J.(Oral) Prayer in this petition filed under Section 439 Cr.P.C. is for grant of regular bail in case FIR No.0050, dated 20.06.2023, under Sections 307, 506, 148 and 149 of IPC, besides Section 25(6) of the Arms Act, 1959, registered at Police Station Tibber, District Gurdaspur. It is contended by learned counsel for the petitioner that though the petitioner is named in the FIR, but it is co-accused Sahibdeep Singh @ Sahib @ Deep, who is alleged to have used pistol and fired upon a car hitting wind shield of the car of the complainant, but no injury was caused to anyone. It is further contended that it is a case of no injury and no person was injured.
Learned counsel further contends that the matter has since been compromised amongst the parties on dated 15.08.2023 (Annexure P2). Even the quashing petition has also been filed, in which parties have been directed to appear before the Trial Court for getting their statements recorded with regard to the compromise, vide order dated 11.09.2023 passed in CRM-M-44943-2023 (Annexure P-3). Learned counsel also contends that co-accused Baljit Singh @ Leader has already been allowed bail vide order dated 12.09.2023 (Annexure P-4) passed in CRM-M43956-2023. Mr. Parneet Singh Pandher, AAG, Punjab accepts notice on behalf of respondent-State, who does not dispute the aforesaid facts. As per custody certificate placed on record by learned State counsel, petitioner is in custody for the last 03 months and 19 days Having regard to the aforesaid factual position, but without commenting anything upon the merits of the case, the petitioner is admitted to regular bail and he is ordered to be released on bail on his furnishing bail bonds and surety bonds to the satisfaction of learned Trial Court concerned.
