RAMENDRA JAIN, J. (ORAL) In compliance of order dated 19.01.2018 passed by this Court, affidavit of the appellant has been produced, wherein he has undertaken to vacate the demised shop on or before 23.10.2018. The same is taken on record.
The instant appeal was filed on 22.12.2017. Nine months from that date would expire on 21.09.2018. Therefore, the appellant is directed to vacate the demised shop on or before 21.09.2018 instead of 23.10.2018. It is clarified that the appellant shall be bound by his aforesaid affidavit and, in case, of violation of the same, the appellant would be liable to pay ` 1,000/- per day as compensation to the respondent after 21.09.2018. -2RSA No.104 of 2018 (O&M) The executing Court shall adjourn the case after 21.09.2018 and shall proceed further, in case, the appellant does not vacate the demised shop by 21.09.2018 in view of his undertaking/order of this Court. Appeal is disposed of accordingly.
