CORAM:

HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Mr. Rakesh Bakshi, Advocate, for the applicant. Mr. V.M. Gupta, Advocate, for the respondent. **** Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Patiala to Jagadhari. It is urged before the court that the distance between the two places is about 130 Kms. Besides, there is no male member in the family and father of the applicant has expired. Applicant has to look after 06 year old child and has financial constraints. It would be difficult for her to defend the proceedings pending at Patiala.

Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Patiala be transferred to a court of co-ordinate jurisdiction at Jagadhari.
