The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 1 to re-issue him passport.

The petitioner vide application dated 17.07.2023 applied for passport. An FIR No. 760 dated 29.11.1999 under the Prevention of Atrocities Act has been registered against the petitioner. The respondent No. 1 on account of pendency of aforesaid FIR has not issued passport to the petitioner.

Learned counsel for the petitioner submits that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391. PARAMJIT KAUR SAINI 2023.10.03 16:49 I attest to the accuracy and authenticity of this order/judgment

Learned State counsel, who on advance notice is present in Court, on instructions from ASI Pawan Kumar, submits that police has prepared untraced report and it is yet to be presented. 5.

Learned counsel for Union of India, who on advance notice is present in Court, submits that passport authority would pass an appropriate order after considering the afore-stated judgment within six weeks. 6.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statements of both sides, petition stands disposed of.
