The present petition has been filed challenging the order dated 06.10.2022 granting interim maintenance.

On 18.04.2023 the following order was passed : "After arguing for a while, learned counsel for the petitioner prays for an accommodation to seek instructions with regard to the arrears of maintenance outstanding.

The petitioner is directed to file an affidavit qua the same, in case he has remitted any amount under any other order of any Court of competent jurisdiction. Adjourned to 22.05.2023."

Thereafter, on 22.05.2023 none had put in appearance on behalf of the petitioner and the following order was passed : "There is no representation on behalf of the petitioner. Order dated 18.04.2023 has yet not been complied with.

In the interest of justice, adjourned to 12.10.2023. Needful be done before the next date of hearing positively, failing which the Court shall proceed in accordance with law."

Today again none has put in appearance on behalf of the petitioner despite the case being called twice. It appears that the petitioner is not interested in pursuing the present petition. This Court is left with no other option but to dismiss the present petition for non-prosecution. 5.

Dismissed for non-prosecution. Pending applications, if any, also stand disposed off.
