****** ANOOP CHITKARA , J.(ORAL) Prayer in this petition is for quashing of order dated 20.08.2024 (Annexure P-2) passed by the learned Additional Sessions Judge, Jalandhar, whereby, the petitioner was directed to deposit 20% of the amount of compensation.

Counsel for the petitioner submits that the petitioner is not in a condition to deposit 20% of the cheque amount. He has handed over a copy of affidavit reflecting his financial capacity. He further submits that the petitioner is ready and willing to deposit Rs.25,000/- before the concerned Court on or before 16.11.2024.

On the other hand, counsel for the respondent submits that instead of depositing the amount, the Appellate Court be directed to decide the appeal in a time bound manner.

Given undertaking of the petitioner to deposit Rs.25,000/-, the present petition stands allowed and order dated 20.08.2024 is set aside SMRITI 2024.10.23 09:51 I attest to the accuracy and authenticity of this order/judgment

CRM-M-48160-2024 -2subject to the condition that the petitioner shall deposit Rs.25,000/- before the trial Court on or before 16.11.2024. As concerned for the directions to Appellate Court to decide the appeal in a time bound manner, this Court refrains from passing such order but keeping in view the request of the counsel for the respondent, the petitioner is directed not to seek any adjournments before the Appellate Court and cooperate in the early disposal of the appeal.
