IN THE HIGH COURT OF PUNJAB & HARYANA AT

CHANDIGARH CR No.5812 of 2023 (O&M) Date of Decision: 24.01.2024 Laxmi Devi and another .....Petitioners.

Versus

Krishan Kumar and another .....Respondents.

CORAM:

HON'BLE MRS. JUSTICE MEENAKSHI I. MEHTA ***** Present:- Mr. Amit Kohar, Advocate for the petitioners.

Mr. Shrey Sachdeva, Advocate for the respondents.

MEENAKSHI I. MEHTA, J. (Oral) By filing the instant revision-petition under Article 227 of the Constitution of India, the petitioners-plaintiffs have sought the indulgence of this Court for the issuance of direction to learned Civil Judge (Junior Division), Fatehabad (for short, 'the trial Court') to dispose of Civil Suit No.656 of 2022 titled as 'Laxmi Devi & anr vs. Krishan Kumar & anr' in a time-bound manner, preferably on the next date of hearing or within two months from the date of the order, as may be passed by this Court, while averring that the said Suit is pending since July, 2022 and the parties have already made their statements, admitting the claim of each other therein. 2.

I have heard learned counsel for both the parties in the present revision-petition and have also perused the file carefully. YAG DUTT 2024.01.29 13:22 I attest to the accuracy and authenticity of this order/judgment

CRR No.5812 of 2023 (O&M) -2- 2024:PHHC:009456 3.

Keeping in view the facts that the above-referred Civil Suit was filed in July, 2022 and is, thus, pending adjudication for the last about one and a half year only and that the petitioners-plaintiffs have not been able to show/make out any cogent and plausible ground so as to categorise the pendency of the afore-said Civil Suit to be an extra-ordinary situation, this Court does not find it expedient and appropriate to issue the direction, as prayed for by them (petitioners-plaintiffs) in the instant revision-petition. 4.

Resultantly, the revision-petition in hand stands dismissed accordingly.
