**** RAMESHWAR SINGH MALIK, J. (Oral) Applicant-wife, by way of instant transfer application under Section 24 of the Code of Civil Procedure, 1908, seeks transfer of a petition under Section 25 of the Guardian and Wards Act, 1890, ('the Act' for short), filed by the applicant herself, from Patiala to Amloh, District Fatehgarh Sahib.
Notice of motion was issued and in the meantime, trial court was directed to adjourn the case beyond the date given by this Court. Heard learned counsel for the parties.
Learned counsel for the respondents, at the very outset, submits that he has got instructions to say that respondents have got no objection in case instant transfer application is allowed. In view of the abovesaid statement made by learned counsel for the respondents, present transfer application is allowed. TA No. 456 of 2015 (O&M) Accordingly, petition under Section 25 of the Act is ordered to be transferred from Patiala to Amloh, District Fatehgarh Sahib. The learned District Judge, Patiala, is directed to send complete record of the abovesaid petition to the learned District Judge, Fatehgarh Sahib, at an early date but in any case within a period of one month from the date of receipt of certified copy of this order.
The learned District Judge, Fatehgarh Sahib, is also directed assign the abovesaid case to the learned court of competent jurisdiction at Amloh, for an early decision, in accordance with law. With the abovesaid observations made and directions issued, present transfer application stands disposed of, however, with no order as to costs.
