This is a petition under section 24 of Code of Civil Procedure seeking transfer of proceedings initiated by husband-respondent under sections 13 & 26 of the act from Panipat to Rohtak. It has been urged before the court that petitioner is medically unfit as she has met with an accident due to which she has not been able to walk without support. Besides, distance between two places is more than 100 kilometers. Thus, it would be difficult for her to defend the proceedings at Panipat. Plea for transfer has been opposed by counsel representing the respondent.
Keeping in view facts and circumstances of the case, it is hereby directed that proceedings pending before the court at Panipat under sections 13 & 26 of the Act be transferred to court of coordinate jurisdiction at Rohtak.
