*** PANKAJ JAIN, J. (ORAL) Present writ petition has been filed under Article 226/227 of the Constitution of India by the petitioners challenging the order dated 02.09.2022 (Annexure P-8) whereby the representation of the petitioner in part has been allowed and so far as ACP on completion of 24 years is concerned the same stands declined as the petitioner got promoted before the said relief became permissible to him and also was ordered to retire on attaining the age of superannuation on 30.4.2011.

CWP No. 4036 of 2023 He accepts notice on behalf of the respondents. Admittedly, the petitioner retired on 30.4.2011. However, in the present writ petition he wants to unsettle and claim all the financial benefits granted to him even prior to the date when ACP Scheme was promulgated on 1.1.1996 and claims that the ACP increments became permissible to him w.e.f. 11.1.1987. Thus, by way of present writ petition the petitioner wants to claim benefits alleging that the same are admissible to him even prior to promulgation of the scheme. Apart from that he wants to unsettle the decisions taken more than 20/25 years back.
This Court does not find it to be a fit case to grant any benefit to the petitioner while exercising jurisdiction under Article 226/227 of the Constitution of India that too after more than 12 years for the petitioner having retired. Resultantly, no ground is made out to interfere in the present writ petition. The same is accordingly dismissed.
