1. The petitioner seeks issuance of directions to learned Sub Divisional Judicial Magistrate, Nakodar for expeditious disposal of his application filed under provisions of Section 156(3) Cr.P.C. pertaining to FIR No.32, dated 11.4.2022 registered at Police Station City Nakodar, District Jalandhar Rural, under Sections 379-B, 506, 148 and 149 of Indian Penal Code.

2. Learned counsel for the petitioner submitted that the aforesaid application had been moved seeking monitoring of the investigation by the Court concerned.

3. Pursuant to order dated 24.9.2024, report of learned Sub Divisional Judicial Magistrate, Nakodar has been received. The penultimate paragraphs of the said report are reproduced herein-under:

"It is also mentioned in the said report that another application was given by Hardev Singh son of Kulwant Singh and Bakhshish Singh son of Prem Singh residents of Amarjit Pur for inquiry to S.H.O. P.S. Pankaj Kakkar 2024.12.12 16:15 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh

CRM-M-47685-2024 (O&M) ( 2 ) City, Nakodar, in which accused Jaspreet Singh and Komalpreet Singh, who were earlier nominated, were found innocent. Report of the same has been sent for the approval of the S.S.P. Jalandhar (Rural). Further, as per the report Ranjit Singh has also moved an application for inquiry to S.S.P. Jalandhar (Rural). The matter was inquired by D.S.P. Jalandhar, who has recommended to register the case against petitioner Amrik Singh, as per which case bearing FIR No. 133/2022 under sections 406,420 of IPC, P.S. City Nakodar has been registered against petitioner Amrik Singh. The investigation was mentioned to be pending as per this report also.

Further, again report was submitted on 30.11.2024. As per which it is stated that during investigation no concrete evidence has come on record against Komalpreet Singh and others, so letter has been written to the S.S.P. Jalandhar (Rural) for obtaining approval for filing the cancellation report."

4. Learned State counsel, upon instructions from ASI Amrik Lal, has informed that the investigation stands concluded and cancellation report has been prepared, which is expected to be filed within a period of 2 weeks from today.

5. In view of the aforestated position, the instant petition is disposed off having been rendered infructuous.

6. The Investigating Agency is, however, directed to present the final report expeditiously preferably within a period of 2 weeks from today. Needless to mention, in case the police chooses to file a cancellation report, the Trial Court concerned shall issue requisite notice to the complainant and the complainant would be at liberty to oppose the same as well as to file protest petition or take other necessary steps.
