(Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 12 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Panchkula to Yamuna Nagar at Jagadhari. It is urged before the court that certain litigation is already pending at Yamuna Nagar. Distance between the two places is almost 140 Kms. Besides, applicant is unemployed and is dependant on her parents. Due to financial constraints, it would be difficult for her to defend the proceedings pending at Panchkula.

Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 12 of the Act at Panchkula be transferred to a court of co-ordinate jurisdiction at Yamuna Nagar (Jagadhari).

The petition is allowed in these terms.
