This appeal has been filed by the appellant-husband challenging judgment dated 18.09.2018, passed by the learned Civil Judge (Sr. Division), SAS Nagar, Mohali, whereby petition under Section 9 of the Hindu Marriage Act, 1955, filed by him, has been dismissed. There is a delay of 299 days in filing of this appeal. Perusal of file reveals that this appeal was listed for the first time on 18.10.2019 and has been adjourned on various occasions either at request of learned counsel for the appellant or due to his absence. On the last date of hearing, despite the matter being called twice, none had appeared on behalf of the applicant-appellant. Today again, despite the matter being called twice, there is no representation on behalf of the applicant-appellant. It appears that the applicant-appellant is not interested in pursuing the matter any longer. Appeal is accordingly dismissed in default.
