NAMIT KUMAR J. (Oral) Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, quashing the order dated 11.09.2024 (Annexure P-2), passed by respondent No.3, whereby the petitioner being Junior Engineer (Elec.) in the office of DS Sub-Division, Naushera Pannuan under (DS DIV. S/U Tarn Taran), has been transferred to DS SubDivision Shankar under (DS DIV. SUB URBAN, NAKODAR) in violation to the annual posting, transfer and placement policy of PSPCL officers/officials dated 16.12.2019 (Annexure P-3). Further a writ of mandamus has been sought for directing the respondents to allow the petitioner to remain posted at DS Sub-Division Naushera Pannuan under (DS DIV. S/U Tarn Taran). Further prayer has been made to stay the operation of the impugned order dated 11.09.2024 (Annexure P-2), during the pendency of the writ petition.

CWP No.24208 of 2024 (O&M) Learned counsel for the petitioner submits that the petitioner is due to retire on 28.02.2025, however, vide impunged order dated 11.09.2024 (Annexure P-2), he has been ordered to be transferred from Naushera Pannuan to Shankar, Nakodar. He further submits that the petitioner shall file a detailed representation to respondent No.1 however, a direction be issued to the respondents to consider the said representation in a time bound manner.

Mr. Taqdeerjeet Singh Sidhu, Advocate for Mr. Ramdeep Partap Singh, Advocate, accepts notice on behalf of the respondents and has no objection to the prayer made by learned counsel for the petitioner.

Accordingly, the present petition is disposed of with a direction to the respondents that if any such representation is filed by the petitioner within a period of two weeks from today, the same shall be considered and decided by the respondents within a period of four weeks thereafter.

In the meanwhile, operation of the impugned order dated 11.09.2024 (Annexure P-2), shall remain stayed, till the final disposal of the representation.
