HON'BLE MR. JUSTICE RAJAN GUPTA HON'BLE MRS. JUSTICE MANJARI NEHRU KAUL
Present:
Mr. N.S.Panwar, Advocate, for the appellant.
***** RAJAN GUPTA , J. (Oral) It appears that the petitioner No.1 (respondent herein) alongwith petitioner No.2 (appellant herein) presented a joint petition under Section 13-B of the Hindu Marriage Act seeking decree of divorce by mutual consent before the court below. Parties made their statement at the first motion stage. A cheque for a sum of Rs.1,50,000/- was also handed over to the wife namely Reena. The matter was, thereafter, adjourned for recording the statements of the parties at the stage of second motion. Learned counsel for petitioner No.1-Reena has informed the court that the cheque issued by petitioner No.2-husband namely Manjeet, at first motion, had been dishonoured. In view of same, petitioner No.1 withdrew her consent and did not depose at the second motion stage. Court, thus, had no option but to dismiss the petition. Only ground agitated before this court is that an RTGS had been made in the account of petitioner No.1-Reena. We did not find any ground SUKHPREET KAUR 2019.11.14 10:38 I attest to the accuracy and integrity of this document
