Mr. Brij Mohan, Advocate, for Mr. Simranjeet Singh, Advocate, for the respondent. PARAMJEET SINGH DHALIWAL, J. (ORAL) Instant petition under Section 24 of the Code of Civil Procedure has been filed seeking transfer of petition titled 'Gurdeep Singh v. Kuldeep Kaur' under Section 13 of the Hindu Marriage Act, 1955 (for short 'the Act') for dissolution of marriage between the parties filed by respondent-husband, from S.A.S. Nagar Mohali to Panchkula. Learned counsel for the petitioner contended that respondent has filed a petition under Section 13 of the Act at S.A.S. Nagar, Mohali, which is pending in the Court of learned Additional District Judge, S.A.S. Nagar, Mohali. Now petitioner is residing with her parents and minor daughter at District Panchkula. It is further contended that a petition under Section 125 Cr.P.C. against the respondent-husband is
-2TA No.652 of 2015 pending at Kalka. Therefore, the case under Section 13 of the Act may be transferred to Panchkula.
Learned counsel for the respondent, after seeking instructions from the respondent, states that he has no objection if the case filed by respondent-husband under Section 13 of the Act is transferred to Panchkula.
Without going into the merits of the case, with the consent of the learned counsel for the parties, request is allowed. Petition under Section 13 of the Act pending in the Court of Additional District Judge, S.A.S. Nagar is ordered to be transferred to learned District Judge, Panchkula, who may assign the same to the Court of competent jurisdiction there. Learned Additional District Judge, S.A.S. Nagar, Mohali, shall ensure that entire record of the case is sent to learned District Judge, Panchkula. The parties through their learned counsel are directed to appear before learned District Judge, Panchkula on 02.02.2016.
