(ORAL) Having suffered concurrent adverse findings by the two Courts below, appellant/defendant is in second appeal before this Court assailing learned trial Court judgment and decree dated 17.12.2013, as upheld by learned First Appellate Court vide its judgment and decree dated 04.05.2016, decreeing the suit of plaintiff/respondent for possession of residential house as shown with yellow colour and marked with letters EFGC which is part and portion of residential house of plaintiff, as shown in the site plan with red colour marked with letters ABCD, situated within the locality of Ashoka Colony, Bhiwani. 2.

Appeal was filed in the year 2018. Notice has not been issued till date and there is no stay. On a Court query whether impugned judgment/ decree has been implemented, learned counsel for appellant pleads lack of instructions. 3.

Be that as it may, dismissed for non-prosecution. 4.

Pending application(s), including application for condonation of delay, shall also stand disposed of.
