Learned counsel for the appellant submits that contesting parties in this case are respondents no. 1 and 3. Respondent no. 2 being vendor of appellant is not contesting party, as such, he claims no relief against respondent no. 2 in this appeal and withdraws the same. For respondent no. 1 and legal heirs of respondent no. 3, the matter has been compromised and a compromise deed (Annexure A-1) has been placed on file. The payment of land in question as per agreement has already been made to respondent no. 1 and legal heirs of respondent no. 3, as such, the appeal may be decided as per compromise.
Learned counsel for respondents no. 1 and 3 endorses the submission of learned counsel for appellant and has no objection if the appeal be decided as per compromise deed (Annexure A-1). In view of submission of learned counsel for parties, the appeal against respondent no. 2 is dismissed as withdrawn. Against respondents no. 1 and 3 it is allowed as per compromise deed (Annexure A-1), which is made part of paper-book as Ex. C-1. The compromise deed (Ex. C-1) shall be read as part of the decree.
