(Oral) The instant petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail, in case FIR No. 159, dated 07.09.2019, registered under Sections 363, 366, 376 IPC and Sections 3 & 4 of the POCSO Act, 2012, at Police Station Boha, District Mansa. Learned counsel for the petitioner submits that a false case has been registered at the instance of the mother of the prosecutrix. It was further contended that the petitioner had performed the marriage with the prosecutrix, as a result of which, the complainant-mother was inimical towards him and had got registered a false FIR against him.

However, a bare reading of the FIR in question reveals that there are serious and grave allegations against the petitioner of having enticed away the minor daughter of the complainant on the pretext of marriage. Since, it is the admitted case of the petitioner that he has solemnized the marriage with the daughter of the complainant, who is a minor, no ground for grant of anticipatory bail is made out. Dismissed.
