Present petition has been filed under Article 226 of the Constitution of India for directing respondents No.2 to 10 to ensure the protection of life, liberty and property of the petitioners at the hands of private respondents No.11 to 14, who are hell bent upon causing loss and damage to the ancestral property and many other assets of the petitioners. It is also prayed to direct official respondents to restrain the private respondents from alienating/selling/altering off the ancestral property and any other assets of father of the petitioners, namely, Nirmal Singh Mann, situated at Mann Farm House, Chak-Mai Dass, P.O. Sarhala Renuan, Nawan Shehar, Punjab.

It has been submitted by learned counsel for the petitioners that petitioners are the owners of the land of which the respondents are forcibly trying to take the possession and time and again threats are being extended MEENU 2025.01.16 10:42 I attest to the accuracy and integrity of this document

CRWP-9179-2024 -2to the petitioners for which they have already approached respondents No.3 and 8, i.e. Additional Director General of Police, NRI Wing Punjab Police, Phase -7, SAS Nagar, Mohali, and Senior Superintendent of Police, SBS Nagar, Punjab, by way of filing separate representations, dated 03.04.2024 and 10.09.2024 respectively, however, no action has been taken on the same till date.

Notice of motion to official respondents only at this stage. 4.

On asking of the Court, Mr.Tarun Aggarwal, Sr.DAG, Punjab. who is present in Court, accepts notice on behalf of the respondents/State and has submitted that civil litigation is already going on between the parties. However, he submits that representation, Annexure P-7, filed by the petitioners would be taken into consideration and the necessary action would be taken on the same as per law.

In view of the aforesaid statement made by learned State counsel, the present petition is disposed of with a direction to respondent No.8-Senior Superintendent of Police, SBS Nagar, Punjab, to take into consideration the grievances raised by the petitioners in the representation (Annexure P-7) of the petitioners, and take appropriate action by deciding the same within two weeks from today in accordance with law.
