The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to Director Public Instruction Colleges, Punjab to immediately stop 95% Grant-in-aid of DAN College, Nawanshahr and recover Rs.73,18,348/- from Mr. Shakti Kumar Sobti and responsible DPI as well as college officials. 2.

As per petition, the respondent-college is a Government aided college. In the college, Shakti Kumar Sobti-respondent No.5 was appointed as Clerk in 1976. He was promoted as Office Superintendent Grade-II on 24.11.2001. He was not possessing requisite qualification. He admitted before DPI on 23.06.2014 that his pay was wrongly fixed. Deputy Director vide order dated 04.11.2016 recommended withholding of 95% grant in aid of college and recovery of sum of Rs.73,18,348/- disbursed to Sobti. The petitioner has filed representations to authorities to take action against college and recover aforesaid amount.

Learned State counsel submits that petitioner has approached Educational Tribunal for the grievances raised in the present petition. Matter is still pending before Educational Tribunal. The respondent enquired the matter and no ground was found to withhold grant-in-aid. Accordingly, grant-in-aid was restarted. A proper enquiry with respect to conduct of Shakti Kumar Sobti was also conducted. The authorities have already initiated proceedings in accordance with law. 4.

In the wake of statement of learned State counsel, the petition strands disposed of.
