Prayer made in the present petition is for grant of interest @8% per annum from due date till realization in view of letter dated 25.08.2023, Annexure P-6 issued by the Finance Department. 2.
Learned counsel draws the attention of this Court to Annexure P3, wherein the determination of cadre strength of 20% was made, based on which a tentative list of officers eligible for selection grade of Rs.4100-5300 framed depicted the petitioner at Sr.No.92 thereof. Pursuant thereto, vide order dated 22.12.2021, Annexure P-4, his pay was fixed in the revised pay scale of Rs.13500-17250 w.e.f. 01.01.1996, the same being the corresponding to the pre-revised selection grade of Rs.4100-5300/-, whereafter the arrears of pension were also credited in his account, vide Annexure P-5. Reliance is placed to the order passed by this Court in a batch of petitions with a lead case CWP-23474-2021, which was disposed of on 06.12.
2023 in view of the aforesaid Instructions, which stands complied with by the respondentDepartment releasing the due interest. In this regard, a legal notice dated 15.05.2024 (Annexure P-8) has been served upon the respondents, which has yet not evoked any response. He thus, at this stage, on instructions, prays that HAMANT 2024.10.
CWP-24265-2024 a direction be given to the respondents to decide the same in a time bound manner.

At the asking of the Court, Ms. Mamta Singla Talwar, DAG, Haryana accepts notice on behalf of the respondent-State and has no objection to the limited prayer made.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to the respondents to decide the legal notice dated 15.05.2024, Annexure P-8, taking note of the afore-referred judgment as also the Instructions, within a period of 2 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same shall contain reasons and the petitioner shall be free to seek legal redress thereupon.
