The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.65, dated 21.5.2022, Police Station Sector-26, Chandigarh, under Sections 419, 420 and 120-B of Indian Penal Code.

The allegations, in nutshell, are that on 21.5.2022, during the course of physical examination for recruitment of Firemen, which was being conducted in Police Line, Sector-26, Chandigarh, three persons were found impersonating for other candidates. It is the case of prosecution that the person, who appeared as Vikram Singh was infact Vijay Kumar, the person who appeared as Aman was Vikas and the person who appeared as Anand was Vineet. ( 2 ) CRM-M-52093-2022 (O&M) one boy namely Partik (petitioner) had appeared in his place during written examination and had demanded an amount of Rs.8 lakhs from him. 3.

Learned counsel for the petitioner submitted that the petitioner was never ever apprehended at the spot and has been named solely on the basis of disclosure statement of one Aman, which would hardly carry any evidentiary value and that in these circumstances, the petitioner deserves the concession of anticipatory bail.

Opposing the petition, learned State counsel has submitted that pursuant to disclosure statement made by Aman, the video recording in respect of written examination was scrutinized and it was found that the petitioner indeed had appeared in place of Aman in the written examination. The learned State counsel has today furnished a printout of the video recording indicating the petitioner sitting in the examination hall with an admit card. The same is taken on record.

This Court has considered the rival submissions. 6.

Having regard to the fact that the police is in possession of the video recording indicating the petitioner had impersonated as Aman during the course of written examination, this Court does not find any special case for grant of anticipatory bail.
