(ORAL) Through this petition, the petitioner seeks anticipatory bail in case bearing FIR No.74 dated 17.09.2019, under Section 420 IPC, registered at Police Station Joga, District Mansa. Vide order dated 09.12.2021, the matter was referred to the Mediation and conciliation Centre of this Court and the parties were directed to appear before the Mediator on 21.12.2021, for an amicable settlement.
As per the report of the Mediator dated 21.04.2022, the dispute between the parties has since been settled. Learned counsel for the petitioner submits that the petitioner has already paid the substantial amount and that he is handing over a cheque amounting to Rs.2,50,000/- dated 30.10.2022 drawn on HDFC Bank to the learned counsel for respondent No.2, in the Court. CRM-M-44437-2019 (O&M) -2Learned State counsel, on instructions from ASI Jagdish Rai, submits that the petitioner has joined the investigation and is now not required for any further investigation. He further does not dispute the factum of compromise effected between the parties. In view of the above, without commenting on the merits of the case, the present petition is allowed and the order dated 08.11.2019 granting interim bail to the petitioner, is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
