Mr. Sunish Bindlish, Advocate is present on behalf of the Food Corporation of India (respondents No.4 to 7) and Mr. A.B.S.Sidhu, Advocate is present on behalf of respondent No.8. Learned counsel for respondents No.4 to 7 submits that respondent No.8 (Angrej Singh) was declared technically responsive/compliant and upon being adjudged L1, was awarded the contract on July 16, 2024. He further submits that respondent No.8 is infact executing the work and work valuing Rs.50 lakhs has already been executed. He further submits that even if, for the sake of arguments, respondent No.8 is held to be technically ineligible, the only and inevitable option for respondents No.4 to 7 would be to scrap MAMTA MALHOTRA 2024.09.25 10:37 I attest to the accuracy and authenticity of this order/judgment Chandigarh the tendering process and invite tender afresh. It is submitted that in any





























case, the petitioner being L3, would not be entitled to stake his claim for award of the contract.

Faced with this, learned counsel for the petitioner fairly submits that it would be futile to pursue the matter any further. Accordingly, he, upon instructions, submits that he be permitted to withdraw the instant petition. Dismissed as withdrawn.

However, the questions that arise for consideration in the matter are kept open, to be decided in appropriate proceedings.
