IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH TA-903-2015 (O & M) Date of decision: 16.08.2016 Sukhwinder Kaur ....Applicant(s) V/s Dilbagh Singh
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. R.S. Budhwar, Advocate, for the applicant. None for the respondent.
Rajan Gupta, J. (Oral) This is a petition seeking transfer of proceedings initiated by husband-respondent under Section 9 of the Hindu Marriage Act, 1955, (for short 'the Act') from the court at Ludhiana to Rajpura. It is urged before the court that the proceedings under Section 125 Cr.P.C. are already pending at Rajpura. Besides, petitioner has two minor children to look after. It would be difficult for her to defend the proceedings pending at Ludhiana.
Keeping in view facts and circumstances of the case, it is directed that proceedings under Section 9 of the Act at Ludhiana be transferred to a court of co-ordinate jurisdiction at Rajpura. The petition is allowed in these terms.
