Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the official respondents No.2 to 3 for compliance of the order dated 16.07.2024 (Annexure P-3), passed issued by respondent No.2. Further prayer has been made to decide the representation dated 20.01.2025 and 04.02.2025 (Annexures P-1 and P-2), by passing a detailed speaking order in a stipulated period of time. Another prayer has been made to direct respondents No.2 and 3 to comply and enforce the order dated 16.07.2024 (Annexure P-2) and to restrain respondent No.3 from making any caste-based deployment or assignment of Safai Sewak workers in Pathankot. 2.

Learned State counsel, appearing on advance notice, submits that he has no objection, in case a direction is issued to the respondent No.3 for time-bound consideration and decision of the representation of the petitioners by passing a speaking order. 4.

Therefore, in view of the limited prayer made by learned counsel for the petitioners, the respondent No.3 is directed to consider the representation (Annexure P-2) of the petitioners and pass a speaking order by specifically dealing with the objection raised by the petitioners with regard to arbitrarily cherry picking them and their similarly situated counter-parts from the community to which the petitioners belong, after affording an opportunity of hearing to the petitioners, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioners. Needless to say, if the petitioners are found entitled to the relief sought, the same shall be granted forthwith by respondent No.3. 5.

Disposed of, accordingly.
