HARPREET SINGH BRAR J. (Oral) CM-11550-CWP-2025 Prayer in this application filed under Section 151 CPC is for preponing the date fixed in the main writ petition. Heard.

For the reasons stated in the application, the same is allowed and the main case, which is fixed for 12.11.2025, is taken on board today itself.

CWP-22263-2023 (O&M) Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of

certiorari, for quashing the impugned order dated 04.08.2023 (Annexure P-2) whereby the petitioner has been ordered to be transferred from the office of DS Division Lehra Gaga (1/DS SubDivision Bangan) to the office of DS Sub-Division Amarkot under DS Division Bhikhiwind on administrative ground being illegal, arbitrary and violative of transfer policy dated 16.12.2019 (Annexure P-3) and office order dated 31.05.2023 (Annexure P-7). Further prayer has been made to quash the impugned order dated 09.08.2023 (Annexure P-5) whereby the petitioner has been relieved by respondent No.3. Another prayer has been made to stay the operation of the order dated 04.08.2023 (Annexure P-2), during the pendency of the present petition. Learned counsel for the respondents, at the very outset, submits that the respondent/Corporation intends to withdraw the impugned order(s) and pass afresh posting order within a period of four weeks from today in order to enable the petitioner to render his services to the respondent/Corporation.

In response, learned counsel for the petitioner submits that he has no objection in case the respondent/Corporation withdraws the impugned order(s).

In view of the statement made by learned counsel for the respondents, the present petition is disposed of. The impugned orders dated 04.08.2023 (Annexure P-2) and dated 09.08.2023 (Annexure P-5) are set-aside and the respondent/Corporation is directed to pass afresh posting order within a period of four weeks from today.

Pending miscellaneous application, if any, also stands disposed of.
