Prayer in this writ petition filed by the petitioners under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent - Department to release arrears of revised pension to the petitioners accrued on account of implementation of 6th Punjab Pay Commission in view of the letter dated 29.10.2021 (Annexure P-2) in view of judgment passed in CWP No.12980 of 2015 "Mohinder Singh vs State of Punjab", decided on 25.07.2016 (Annexure P-4).

Learned counsel for the petitioners, at the very outset, confines his prayer for deciding legal notice dated 19.06.2024 (Annexure P-5). He submits that at this stage, petitioners would be satisfied, if the said legal notice is considered and decided by passing a speaking order within a time-bound frame.

Mr. Surya Kumar, AAG, Punjab, accepts notice on behalf of respondent No.1 and Ms. Roja Agnihotri, Advocate has accepted notice on behalf of respondents No.2 to 4 and have no objection to the innocuous prayer made by learned counsel for the petitioners. 5.

I have heard learned counsel for the parties and have gone through the record of the case.

Without expressing any opinion on merits of the case or the claim being made by the petitioners in the present petition, respondent No.2 is directed to consider and decide the claim made by the petitioners in legal notice dated 19.06.2024 (Annexure P-5), in accordance with law, by passing a speaking order within a period of three months from the date of receipt of certified copy of this order. In case, the petitioners are found entitled, necessary benefits be released within a period of three weeks thereafter.

The petition stands disposed of.
