IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH (O&M) Date of Decision: 24.05.2023

....Petitioner

Versus

...Respondents

CORAM: HON'BLE MR. JUSTICE Present :

Mr. Vivek Sharma, Advocate for the petitioner.

     !""#!

$% , J. (Oral) 1.

The petitioner is stated to be already working in National Fertilizer Limited which is a Government owned company. He was issued an offer of appointment as a Vocational Lecturer on 04.12.2014, requesting him to join within a period of 15 days. On the application submitted by the petitioner the joining period was extended by 15 days apart from the original 15 days. This communication was sent through a registered post to the petitioner on 31.12.2014, however, he did not join. On 05.01.2015, he requested for the issuance of appointment from 1994. Thereafter, the offer of appointment issued to the petitioner was cancelled on 04.03.2015. Challenging the correctness of the aforesaid order, the present writ petition has been filed. Learned counsel representing the State of Punjab, while contesting the writ petition, has submitted that vide registered letter dated 31.12.2014, the petitioner was once again offered an appointment after granting 15 days extension, however, he did not join. -&- 2.

Learned counsel representing the petitioner contends that the petitioner was entitled to be appointed in the year 1994, hence, the order cancelling the offer of appointment is not sustainable. 3.

On the other hand, learned State counsel submits that because the petitioner never came forward to join, after availing the extended period of joining, he does not deserve any relief.

4.

This Court has considered the submissions of learned counsel representing the parties and perused the record. 5.

As far as grievance of the petitioner that he is entitled to be appointed with effect from 1994 is concerned, the same will fail only because the petitioner did not join the post of Vocational Lecturer for the period of last more than 08 years.

6.

In view of the aforesaid facts, this Court does not find appropriate to grant any relief to the petitioner. 7.

Dismissed.
