***** Learned counsel for the petitioners has filed this review petition pointing out that on account of his personal difficulties, he was unable to appear in the Court on the day when this Court passed the order on 01.09.2023. He submits that as the petitioners were promoted after being re-designated as clerks, subsequently, the writ petition itself had become infructuous, but since the facts could not be brought to the notice of the Court, the order has been passed on merits, which was not required to be gone into. It is further stated that the post of Traffic Enumerators was merged subsequently, and the petitioners were confirmed as clerks and were further promoted up to the post of superintendent, and have also superannuated from the said post. Since both the petitioners have attained superannuation, the order passed by the Court dated 01.09.2023 be therefore recalled and the writ petition be disposed of as having become infructuous.

Learned counsel for the State does not accept notice but does not object to the contentions of the counsel for the petitioners. In view thereof, this review petition is allowed. The order dated 01.09.2023 passed in CWP-18409-1996 is recalled. Writ Petition is disposed of as having become infructuous in view of the statement made by the learned counsel for the petitioners at bar as noted above.
