During the course of hearing, the learned counsel representing the respondents No.1 to 3 has filed a deed of compromise, allegedly arrived at between the parties. It appears that all the parties to the litigation have signed each page of the deed of settlement, on 26.02.2022. 2.

The learned counsel representing the appellants admits that fact and submits that the lawyer, representing the appellants before the trial Court, has confirmed this fact. However, he submits that he did not get a chance to speak to the appellants, personally, in this regard., 3.

Keeping in view the aforesaid facts, the deed of settlement is taken on record as Ex.HC-I.

Regular Second Appeal No. 2210 of 2017 (O&M) 4.

In view of the aforesaid fact, the appeal is disposed of in terms of the settlement, which shall form part of the decree. The appellants shall have the liberty to file an application to recall, within a period of one month, from today.
