The petitioner through instant petition under Article 226 of Constitution of India is seeking directions to the respondents to re-issue passport.

Learned counsel for the parties are ad-idem that passport bearing No.K 2406866 dated 11.01.2013 was issued to the petitioner which expired on 10.01.2023. The said passport was deposited with Additional Chief Metropolitan Magistrate 22nd Court, Andheri, Mumbai in a criminal case. The petitioner was acquitted vide judgment dated 16.03.2022 passed by trial Court and in the said judgment passport authority was asked to revoke passport of the petitioner.

The petitioner is seeking re-issuance of passport whereas the trial Court has ordered to revoke his passport. In the light of judgment dated 16.03.2022 passed by the trial Court, this Court cannot ask the Anju Goel 2024.01.16 18:23 I attest to the accuracy and integrity of this document Chandigarh

Faced with this, learned counsel for the petitioner prays for withdrawal of the present petition with liberty to avail remedies as permissible by law.
