Dated Police Station Sections 29.07.2018 Ismailabad, District Kurukshetra 420, 120-B, 406 IPC Seeking quashing of order dated 11.09.2019 (Annexure P-2) passed by JMIC, Pehowa, arising out of the FIR captioned above, vide which petitioner was declared proclaimed offender, he has come up before this Court by filing the present petition under Section 482 CrPC.

Petitioner's counsel submits that vide order dated 23.08.2022 passed in CRM-M29488-2022, this Court had granted anticipatory bail to the petitioner in the present FIR and at that time petitioner was declared proclaimed offender. He further submits that as per his instructions, the said order, whereby petitioner was granted bail, was not assailed before the Hon'ble Supreme Court of India and if it is challenged, they do not have any knowledge, as they did not receive any notice. It is further submitted that petitioner is continuously appearing before the trial Court in the present FIR and he undertakes to appear on each and every date unless there is a justiciable cause.

Given above, present petition is allowed and order dated 11.09.2019 (Annexure P-2), is quashed and set aside. Petitioner is directed to appear before the trial Court on each and every date except when the situation is beyond his control. Pending applications, if any, stand disposed of.
