Learned counsel for the parties are ad idem that the parties to the lis have since compromised the matter vide compromise deed dated 31.10.2022. Parties are present in Court and their statements have been recorded separately. The parties have stated that they have voluntarily entered into a compromise dated 31.10.2022 and they would have no objection if the present appeal is allowed and the suit is decreed in terms of the compromise.

Original power of attorney executed by appellant No.2(b), Arshdeep Singh, in favour of appellant No.2(a) and original power of attorney executed by Daljit Singh in favour of Charan Singh have been shown in the Court.

In view of the statements made by learned counsel for the parties and the parties themselves, the present appeal is allowed. The judgment and decrees passed by the Courts below are set aside and the suit JITENDER KUMAR 2023.05.12 09:04 I attest to the accuracy and integrity of this order/judgment.

RSA No. 2262 of 2017 2023:PHHC:068617 -2accordingly stands decreed in terms of the compromise dated 31.10.2022, original of which has been appended with the application CM-3289-C-2023 as Annexure A-1 and is taken on record as 'Ex.C1'. 4.

In view of the above, the present appeal is allowed in terms of the compromise 'Ex.C1'. Decree-sheet be drawn up accordingly and the compromise 'Ex.C1' be made part thereof. Pending applications, if any, also stand disposed off.
