IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH RSA-227-2017 (O&M) Date of decision : 17.01.2019 Jagdish Parshad (deceased) through LR ... Appellant
Versus
State of Haryana and others ... Respondents
CORAM:
HON'BLE MR. JUSTICE AMIT RAWAL
Present:
Mr. Chanderhas Yadav, Advocate for the appellant.
**** AMIT RAWAL, J. (ORAL) The sole reason given in the application for condonation of delay of 2136 days in filing the appeal is that son of the appellant had suffered a tumour in the month of August 2016 (Annexure A-1). The aforementioned ground would have been satisfied, if the decree is of dated 2016, whereas the judgment and decree of the lower Appellate Court is dated 27.08.2010. No explanation has come forth in not taking any steps, for the entire six years before the ailment of son of the appellant. The application is bereft of justifiable reasons. Accordingly, the application seeking condonation of delay in filing the appeal as well as the appeal is dismissed. 17.01.2019 Yogesh Sharma ( AMIT RAWAL ) JUDGE Whether speaking/reasoned Yes/ No Whether Reportable Yes/ No
