**** ARUN MONGA, J. (ORAL) Having suffered concurrent adverse findings by the two Ld. Courts below, defendant (appellant herein) is in second appeal before this Court assailing Ld. Trial Court judgment and decree dated 18.02.2014, as upheld by Ld. First Appellate Court vide its judgment and decree dated 12.12.2016, decreeing the suit of plaintiff (respondent herein) for alternative relief of recovery of amount of Rs.3,50,000/- with costs and interest @ 9% per annum from the date of agreement to sell in question i.e., 28.05.2004 till date of decree and future interest @ 6% per annum till realization of the decretal amount.

At the outset, learned counsel appearing on behalf of appellant seeks to withdraw the instant appeal.
