Prayer in this writ petition filed by the petitioners under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to release LTC, Medical Allowance, etc. to the petitioners, which have been withheld by the respondent - Department along with interest @ 18% per annum on the delayed payment.

Learned counsel for the petitioners submits that the petitioners are retired employees and are entitled for grant of fixed medical allowance of Rs.1,000/- per month w.e.f. 01.07.2021, in view of Notification dated 07.09.2021 (Annexure P-6). He further submits that the said benefits have not been released to the petitioners despite submitting various representations followed by a legal notice dated 08.05.2024 (Annexure P-8). He further submits that the petitioners would be satisfied in case time bound directions are issued to MOHD YAKUB 2024.09.23 18:11 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh

Mr. Surya Kumar, AAG, Punjab, accepts notice on behalf of respondents No.1 and 2. On the asking of the Court Mr. Shobhit Phutela, Advocate, who is on the panel of Department of Local Government, Punjab, has accepted notice on behalf of respondent No.3 and have no objection to the innocuous prayer made by learned counsel for the petitioners.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.3 to consider and decide the legal notice dated 08.05.2024 (Annexure P-8), submitted by the petitioners expeditiously, by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
