None for the petitioner Mr. Rajat Gautam, DAG Haryana Anoop Chitkara, J. (Oral) On the last date, the petitioner was unrepresented. Even today the petitioner is not present.

Mr. Rajat Gautam, DAG Haryana for the State submits that the charges were framed way back in the year 2020 after filing of the present petition which was for quashing of FIR. Once the charges have been framed by a judicial order then such order would eclipse the police report filed under Section 173 of the Code of Criminal Procedure and it would be necessary for the accused to challenge the judicial order vide which the charges were framed.

CRM-M-44795-2019 (O&M) -2Given above, the present petition has been rendered infructuous and is disposed of as such. Liberty is granted to challenge the charges. Further the time for which the present petition was pending shall not be counted for the purposes of delay in case the petitioner chooses to challenge the order of framing of charges.
