H. S. Madaan, J. (Oral) Vide this order, I intend to dispose of two petitions, bearing CRM-M- 44876 of 2019 titled as 'Hardeep Singh @ Ranjit Singh vs.
CRM-M- 44876 of 2019 -2State of Punjab' filed by the petitioner-Hardeep Singh @ Ranjit Singh for pre-arrest bail in case FIR No. 169 dated 23.8.2018 registered at Police Sation Sadar, Amritsar and CRM-M- 45751 of 2019 titled as 'Gagandeep Singh @ Bullet vs. State of Punjab', filed by petitioner Gagandeep Singh @ Bullet, for grant of regular bail, in cross case bearing DDR No. 40 dated 24.8.2018 in the abovessaid FIR, registered at Police Sation Sadar, Amritsar. Briefly stated, facts of the case as per the prosecution story are that on 22.8.2018, while complainant Prince Kumar son of Durga Parshad, was returning home and on turning point of Mustafabad King, Prince @ Parauntha was spotted coming. Prince @ Parauntha started abusing the complainant and then slapped him also.
Thereafter, complainant alongwith his brothers and father went to the house of Prince @ Parauntha to lodge a protest, in the meanwhile, Gujjar son of Sammi Bhat, Pappu Hawelian Wala, Monu @ Dola alongwith 8-9 persons came and started beating them up. When they went to the Police Station, then Gurdev Singh Sandhu son of Rachhpal Singh Babbu, Honey Jatt, Pappu Hawelian Wala, Mana son of Nishan Singh etc. arrived there and an altercation took place there. However, for the purpose of compromise, it was agreed that parties would meet on the next day at 11.00 A.M.
CRM-M- 44876 of 2019 -3Gopy club Wala armed with pistol, intercepted them, abused them and made assault, giving injuries to them. Shots were also fired. Formal FIR was registered. Cross version was also registered against various persons including Gagandeep Singh @ Bullet and others. In terms of said version Gagandeep Singh @ Bullet was armed with 32 bore pistol and after firing a shot therefrom he had handed it over to Hardeep Singh @ Ranjit Singh - present petitioner. Gagandeep Singh @ Bullet was arrested in this case on 30.8.2019. He had filed an application for regular bail, which was however dismissed by Additional Sessions Judge, Amritsar vide order dated 30.9.2019, as such he has approached this Court asking for similar relief, whereas Hardeep Singh @ Ranjit Singh has filed a petition for grant of pre-arrest bail.
Both the petitions are being resisted by the State counsel. I have heard learned counsel for the parties, besides going through the record.
First coming to the petition for grant of regular bail filed by Gagandeep Singh @ Bullet, nobody was hurt as a result of shot fired alleged to have been shot by the petitioner and as stated by the State counsel Gagandeep Singh @ Bullet has fired in the air. Challan is stated to have been filed against the accused, which is statedly at initial stage. The conclusion of trial shall take a considerable time. Other co-accused of the petitioner namely, Surjit Singh is stated to have been granted bail.
Accordingly, CRM-M-45751-2019 is accepted. Petitioner -
CRM-M- 44876 of 2019 -4Gagandeep Singh @ Bullet is ordered to be released on bail on his furnishing bail bonds and surety bonds to the satisfaction of the trial Court/CJM/Duty Magistrate, Amritsar. However, it is made clear that in case the petitioner is found indulging in any criminal act after being granted bail by this Court, this order shall be liable to be withdrawn.
With regard to the petition for grant of pre-arrest bail filed by Hardeep Singh @ Ranjit Singh, learned State counsel, on instructions from ASI Karam Singh, states that petitioner has joined the investigation and he is not required for custodial interrogation by the local police.
In these circumstances, the interim bail granted to the petitioner vide order dated 22.10.2019 is made absolute, subject to fulfillment of conditions envisaged under Section 438(2) Cr.P.C. Accordingly CRM-M-44876-2019, is allowed.
