HARSH BUNGER, J. (ORAL) Prayer in the present petition, filed under Section 482 of the Code of Criminal Procedure, is for issuance of a direction to respondent No.2 to submit the status report of investigation done by police authorities in FIR No.319 dated 06.09.2017, registered under Sections 323, 341, 427, 506, 148 and 149 of the Indian Penal Code, at Police Station Focal Point, Ludhiana.
Pursuant to order dated 23.11.2022, status report dated 13.02.2023 by way of an affidavit of Murad Jasvir Singh Gill, PPS, Assistant Commissioner of Police, Industrial Area-A, Ludhiana, on behalf of respondents-State of Punjab, has been filed in the Court today, which is taken on record, subject to all just exceptions. CRM-M-52664-2022 -2Learned State counsel, while referring to para No.5 of the status report dated 13.02.2023, submits that after the cancellation report was rejected by the Court of Judicial Magistrate Ist Class, Ludhiana, vide order dated 03.09.2021, further investigation was carried out and now the challan/final report under Section 173 of the Code of Criminal Procedure has been prepared on 18.01.2023 in this case and the same will be submitted before the trial Court shortly.
In view of the above statement, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition. Accordingly, the present petition is ordered to be dismissed as withdrawn.
