During the course of hearing being made upon the instant appeal, the appellant and the respondent appeared before this Court, and, recorded their respective statements, statements whereof become extracted hereinafter.

"Statement of Dinesh Kumar son of Sh. Prem Parkash, resident of near Shivalik School, Bilaspur, District Yamuna Nagar, on oath.

That, I am ready and willing to pay a sum of Rs. 7,50,000/- (Rs. Seven lacs and fifty thousand) to the present appellant, as permanent alimony to her within 15 days from today by transferring the said amount in her Savings Bank Account No. 10312191021175 at Punjab National Bank, ITI, Yamuna Nagar, IFSCPUNB0103110. Accordingly, in terms of my statement, the decree passed by the learned Family Court concerned, on 15.10.2022, upon Hindu Marriage Petition bearing CIS No. 441 of 2018, wherebys the marriage between him and the present appellant was annulled, be affirmed.

That, in view of the statement made by the respondent, I withdraw the instant appeal bearing FAO No. 4870 of 2022. I also state on oath that in terms of the statement made by the respondent, the decree passed by the learned Family Court concerned, on 15.10.2022, upon Hindu Marriage Petition bearing CIS No. 441 of 2018, be made absolute.

In view of the supra made statements by the contesting litigants, the decree passed by the learned Family Court concerned, on 15.10.2022, upon Hindu Marriage Petition bearing CIS No. 441 of 2018, thus annulling the marital ties of the contesting litigants, is made absolute, but subject to the conditions, as embodied in the testification made by the respondent in the instant appeal.

Accordingly, in view of the statement made by the appellant, the instant appeal is dismissed as withdrawn. 4.

Decree sheet be drawn accordingly.
