(ORAL) Prayer in the present petition under section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023, seeking directions to Respondent No. 1 to 3 for proper and fair investigation in the FIR No. 294 dated 07.07.2024 U/s 323 and 341 registered at Police Station Zirakpur (Annexure P-2) for addition of relevant provisions of law as enumerated under representations dated 20.08.2024 (Annexure P-3); and further directions for confiscation of passports of Respondents no. 4 to 7 as per representation dated 03.09.2024 (Annexure P-4); and further protecting the life and liberty of the Petitioner and her family members from the clutches of Respondent No. 4 to 7.
It is the prayer of the petitioner that fair and proper investigation be carried out in the FIR No. 294 dated 07.07.2024 U/s 323 and 341 registered at Police Station Zirakpur (Annexure P-2). CRM-M-47606-2024 (O&M) - 2Jaswant Singh, informs this Court that the petitioner was married to the accused respondent No. 4 on 03.12.2023. There are total 3 accused in the present FIR being respondent No.4-husband; respondents No. 5 and 6 parents-in-law; and respondent No.6-sister-in-law of the complainant/petitioner.
It is submitted further on instructions from SI Jaswant Singh, that the matter is still under investigation. The petitioner has sought enhancement of offences and inclusion of offences under Sections 406 and 498-A IPC in the present FIR. In this regard, report is still pending in the office of concerned SSP. It is further informed that the date of alleged incident is 30.06.2024; FIR has been filed on 07.07.2024; and representation has been filed on 20.08.2024 (Annexure P-3). It is stated that accordingly the present petition is premature as the investigation in the present FIR is still pending. Learned counsel for the petitioner does not dispute the above said facts.
In view of the above, no further directions are required to be issued.
The present petition stands disposed of.
