The plaintiff has filed the regular second appeal against the judgment passed by the learned First Appellate Court dated 03.01.2017. Learned trial Court had decreed the suit vide judgment dated 27.04.2016, however, the leaned First Appellate Court has reversed the same. The plaintiff-appellant claims that her date of birth has been wrongly recorded in her Secondary School Examination Certificate issued by the CBSE.
Learned counsel representing the parties are ad idem that as per the judgment passed in Jigya Yadav (minor) Vs. CBSE and others, decided on 03.06.2021 (Civil Appeal No.3905 of 2011), the CBSE is required to establish an in-house mechanism to redress the grievances with regard to correction in the particulars such as name, date of birth etc. They pray that let ASHOK KUMAR 2021.08.17 16:12 I attest to the accuracy and integrity of this document
RSA-2503-2017 (O&M) this appeal be disposed of by granting an opportunity to the appellant to file a representation along with the supporting material to the CBSE, with a direction to the CBSE to decide the same within a fixed time frame. Keeping in view the aforesaid facts, the appeal is disposed of with a liberty to the appellant to file a comprehensive representation along with supporting documents, if any, for correction of her date of birth. If such representation is filed within a period of one month from today, the same shall be considered and disposed of in accordance with the judgment passed by the Hon'ble Supreme Court in Jigya Yadav (supra) within a period of two months thereafter.
With these observations, the appeal is disposed of. All the pending miscellaneous applications, if any, are also disposed of.
