This is an application filed under Section 151 CPC, for fixing the main appeal from 20.04.2024 to an early/actual date of hearing. II.
Notice of this application to the non-applicant/appellant. III.
Mr. S.S. Rangi, Advocate, who is present in Court, accepts notice on behalf of the non-applicant/appellant and raises no objection in allowing the prayer made in the application.
IV.
Accordingly, date of hearing in the main appeal i.e. RSA-53992014, is advanced from 20.04.2024 to today itself. CM stands disposed of.

On 04.07.2023, following order was passed:- "Present:
Mr. J.S. Sekhon, Advocate for Mr. S.S. Rangi, Advocate, for the appellant(s). Mr. Naresh Kumar, Advocate for

Counsel appearing for the appellant submits that parties to the lis have resolved their dispute by way of compromise-deed dated 08.04.2021, and in support of his submissions, he produced a photocopy of said compromisedeed in Court today, which is taken on record, subject to all just exceptions. Office to tag the same at appropriate place. 2.
Counsel for the appellant requests for recommending the present appeal to the Mediation and Conciliation Centre of this Court. Counsel appearing for the respondent pleads no objection to the request of counsel for the appellant.

Keeping in view the factum of compromise and in view of the request made by counsel for the parties, the matter is referred to the Mediation and Conciliation Centre of this Court. Parties are directed to remain present before the said Forum on 20.07.2023, or any other date fixed by it. 4.
For awaiting report, adjourned to 13.10.2023." 2.
Thereupon, parties appeared before the Mediation and Conciliation Centre of this Court, and as per report dated 11.10.2023, received from the Mediation and Conciliation Centre of this Court, parties have settled their dispute by way of amicable settlement/agreement, which is placed on the case file.
Thus, the dispute between the parties has been finally settled by executing a settlement/compromise dated 11.10.2023, before the Mediation and Conciliation Centre of this Court. Said settlement/compromise is taken on record, subject to all just exceptions. Office to tag the same at appropriate place in the case file.

Learned counsel appearing on behalf of both the sides are ad idem that present appeal be disposed of on the basis of aforesaid

In view of the factum of settlement/compromise dated 11.10.2023, having been executed between the parties before the Mediation and Conciliation Centre of this Court, and keeping in view the stand taken by the parties, present appeal stands disposed of in terms of the said compromise.
Needless to say that parties would be abide by the terms of the settlement/compromise dated 11.10.2023.
Decree sheet be drawn accordingly.
A copy of this judgment & decree, be sent to the learned First Appellate Court as well as learned Trial Court for information. Lower Court Records be also returned forthwith.
