The present Criminal Writ Petition is filed under Article 226/227 of the Constitution of India seeking parole to the petitioner for taking care his wife who is suffering from medical ailment. 2.

Pursuant to order dated 08.05.2026 passed by this Court, learned State counsel has filed status report by way of affidavit dated 28.05.2026 in the Court today. The same is taken on record. 3.

As per the status report, the petitioner has a large criminal history. Although such antecedents would ordinarily constitute a valid ground to decline consideration of his request for parole but there are certain circumstances which persuade us to take a different view. The first circumstance is that the report submitted by the respondent‐State clearly indicates that the petitioner's wife is suffering from a serious cardiac ailment and there is no one in his family who would take care of her. CRWP-8728-2025 (O&M) second circumstance is that, on three previous occasions, the petitioner was granted interim bail/parole, and he did not misuse the concession even once. 4.

In that view of the matter, the present petition is allowed. Consequently, the petitioner is directed to be released forthwith on parole for a period of four weeks to enable him to take care of his ailing wife, subject to his furnishing requisite bail bonds to the satisfaction of the concerned Chief Judicial Magistrate/Duty Magistrate. The petitioner shall surrender before the concerned jail authorities upon expiry of the said period.
