$-& This petition under Article 226 of the Constitution of India has been filed seeking a writ of certiorari for quashing the decision dated 22.01.2016 rejecting the financial bid of the petitioner by the respondent4 corporation. A further challenge has been made to the grant of contract to respondent No.4. The contract was for outdoor advertisement for a period of three years ending on 09.02.2019. Admittedly, the period has come to an end. Thus by efflux of time the reliefs claimed in the petition have been rendered infructuous.

At this stage, learned counsel for respondent No.4 stated that though he had deposited the requisite amount with the Municipal Corporation, Panchkula but on account of an interim order dated 27.01.2016 restraining creation of any right in favour of respondent No.4 the work could not be undertaken and he is entitled for refund of the amount deposited by him.

Be that as it may, it is a matter to be decided by the Municipal Corporation. In case respondent No.4 makes an application for refund of the amount so deposited we see no reason that Municipal Corporation shall not proceed to consider and decide the same in accordance with law by reasoned speaking order preferably within a period of two weeks from the date of receipt of a certified copy of this order.

With the aforesaid observations, the petition is consigned to records as having rendered infructuous.
