The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to consider petitioner for allotment of free paddy.

The respondent has issued Custom Milling Policy for KMS 2023-24. In the policy, schedule of activities has been notified. Different dates for different activities have been prescribed. The last date for final registration was 01.09.2023. The petitioner filed application seeking final registration prior to 01.09.2023, however, it was rejected. The petitioner could not get electricity connection by 01.09.2023. The officials of the respondent inspected premises of the petitioner and found that there was no electricity connection. The petitioner subsequently got electricity connection and requested for re-verification. In the re-verification, the petitioner was found eligible for registration as well as allotment of paddy. CWP No.22232 of 2023 -2- 2023:PHHC:128879 petitioner stands registered. The petitioner apprehends that he would be allotted only RO paddy whereas he is entitled for free paddy. 4.

Mr. Deepanjay Sharma, DAG, Punjab who on advance notice is present in Court submits that petitioner could not get final registration on or before 01.09.2023, thus, the petitioner is not entitled for free paddy, however, petitioner is entitled for RO paddy.

Without commenting upon the merits of the case, however, considering that petitioner has undisputedly installed plant and machinery prior to 01.09.2023 and there was lack of only electricity connection, respondents are directed to look into representation of the petitioner for allotment of free paddy. The respondents within week shall pass a speaking order in accordance with law and prevailing policy.
