RSA No. 5505 of 2014 (O&M) -1In the High Court of Punjab and Haryana at Chandigarh Regular Second Appeal No. 5505 of 2014 (O&M) Date of Decision: 31.1.2017 Amar Singh .....Appellant

Versus

Kesha Ram and others .....Respondents CORAM: HON'BLE MRS. JUSTICE ANITA CHAUDHRY

Present:

Ms. Meenakshi Poswal, Advocate for Mr. R.S.Mamli, Advocate for the appellant.

Mr. S.S.Dinarpur, Advocate for the respondents.

**** ANITA CHAUDHRY, J Counsel for the respondents states that the appeal has to be dismissed as limited notice was given to see if there was any possibility of amicable settlement. The counsel refers to the order dated 31.10.2014 and also points out that the submission on behalf of the appellant was that they were not touching the merits of the case. Counsel for the respondents further submits that the matter was sent for mediation in 2015 and despite notice nobody had appeared and therefore the matter was sent back and repeated adjournments are being taken by the appellant. Limited notice had been given only to explore the possibility of any settlement. The settlement could not be effected. It appears that the parties were not keen on any settlement. They have failed to appear before the mediators. Report in this regard had been received.
